Sacramento County CCW Denial Appeal Win!

We recently won an internal appeal with the Sacramento County Sheriff’s Office after a CCW denial. Under California’s new “shall issue” CCW licensing framework, Sheriffs and Police Chiefs are required to issue licenses most people. In this case, the Sacramento County Sheriff’s Office denied our client’s CCW license application, alleging that our client was “reasonably likely to be a danger to himself, others, or the community at large…” under Penal Code section 26202(a)(1).

Our client is a 69-year old, decorated veteran with two blips on his record from 2008. He was subjected to a Welfare & Institutions Code section 5150 evaluation related to military stress. And he was arrested for a pepper spray incident where he defended himself while working as a process server. The Sacramento Sheriff’s Office denied his CCW application based on these old incidents. They did not seek a psychological evaluation.

Most of the time, after a CCW license denial, we run straight to court and file a request for hearing per Penal Code section 26206. However, in this case, the Sacramento Sheriff’s Office has an internal CCW denial appeal process.

We connected the client with a mental health evaluator who specializes in assessments of dangerousness. With a favorable report from the evaluator, we drafted a legal brief. In the brief, we cited to recent case law, including the Bruen case from the United States Supreme Court and other appropriate legal authority. We then filed the brief with exhibits, totaling 25 pages, with the Sheriff’s Office. Within a few days, we received a response that the denial was overturned and they were going to proceed with processing the CCW license.
